At the House of Markus Fellowship, we believe the main issue in any legal matter is the Legal Person and the NAME. Throughout our entire lives, we have a legal fiction person attached to us that has almost the exact same name. While this might seem like a very simple concept, it is actually quite complex and usually people have a lot of trouble understanding it. This course is designed to help the member understand these concepts by going over legal definitions and legal explanations of what is called a “legal fiction person,” or a legal person, and the legal name.

As a prerequisite, understanding that legal is not lawful and lawful is not legal, those two terms law and legal are separate. While one thing can be legal, it doesn’t always mean that it is lawful, and vice versa. For example, it is not legal to lie to someone - that is considered fraud. However, legal fiction is built on a lie because it doesn’t exist in reality. So if it doesn’t exist in reality, it is essentially a lie. So while it is unlawful to lie, it is legal if all parties agree that the lie is true. To take this concept a step further, an agreement does not have to be vocalized to be solidified, it can be implied. Verbalizing or vocalizing an agreement, or writing it down is called express - express agreement, express trust, express contract. These are vocal and written agreements, or terms and conditions to the agreement, but an agreement can be made by implication. So while a legal fiction is a lie, or a legal fiction person for that matter, if one offers a legal fiction person existence by stating its name or simply by implying that it actually exists, and another party acknowledges that it exists by either answering to the name or answering to any business that applies to that legal fiction person, there is an implied agreement that everything is “legal,” even though it is unlawful to lie.

For example, if JOHN HENRY DOE is the name of a legal fiction and does not exist in physical reality and a judge says “JOHN HENRY DOE,” and a man stands up by the name of John Henry with a family name of Doe and says, “I am here,” he has agreed to be the legal fiction. From that point forward, all laws that apply to that legal fiction person now apply to that living man in that court room and everything is “legal.”

This is the simplicity of the entire legal system and how it controls us through our legal fiction. This course is designed to get into a detailed explanation from the legal point of view of all these different aspects of the two concepts - the legal person, and the name. However, as we go through this course, keep in mind the simplicity is: if we do not answer to the legal person or for the legal person and to its name, then that is really the most protection that we can have.
