Effective Date: June 12, 2026
This Non-Member Site User Agreement (this “Agreement”) governs access to and use of the House of Markus Fellowship (“HoMF”) website, platform, and related online resources (collectively, the “Platform”) by persons who are not admitted as HoMF Members (“User”). HoMF is a private unincorporated association and an integrated auxiliary of Unity of Divine Creation Ministry (“UDCM”). By accessing or using the Platform, creating an account, downloading materials, using the document generation tools, signing petitions (if offered), or clicking “I Agree,” User accepts and agrees to be bound by this Agreement and HoMF’s posted Policies (incorporated by reference).
1. DEFINITIONS
1.1 “Arbitration Rules” means HoMF’s Bespoke Arbitration Rules in effect as of the Effective Date, as amended pursuant to HoMF governance.
1.2 “Confidential Information” means any non-public information disclosed by or on behalf of HoMF, UDCM, Stewards, Members, or invited participants, including without limitation: internal governance, steward communications, member identities/lists, private platform areas, access methods, security measures, dispute files, drafts, templates, packets, and any materials marked or reasonably understood as confidential.
1.3 “Content” means all text, graphics, images, video, audio, PDFs, books, blog posts, forms, templates, code, and other materials made available on or through the Platform.
1.4 “Document Generator” means the Platform’s document generation tools, including any template logic, workflows, and outputs.
1.5 “Document Generator Output” means any document produced by the Document Generator using User inputs and HoMF template logic.
1.6 “Educational Materials” means non-legal-advice educational content provided by HoMF, including videos, PDF books, articles, guides, checklists, and templates made available for limited educational access.
1.7 “Governing Instruments” means this Agreement, the Arbitration Rules, and HoMF’s posted Policies and any other terms incorporated by reference on the Platform; and, to the extent applicable, HoMF’s Articles/Bylaws.
1.8 “Platform” means the HoMF website, platform, document generation system, community features (forums, messaging), and any associated subdomains or applications controlled by HoMF.
1.9 “Policies” means HoMF’s privacy, cookie (if any), data security, records retention, acceptable use, and access policies published on the Platform and incorporated by reference.
1.10 “Stewards” means individuals holding steward roles under HoMF governance, including designees acting within delegated authority.
1.11 “User” means a non-member individual or entity representative accessing the Platform under an account or otherwise.
2. PRIVATE CONTEXT; SCOPE; ELIGIBILITY; CHANGES
2.1 Private Context; No Public Dedication. HoMF operates privately and does not dedicate its internal governance, member identities, or internal processes to public administration. User acknowledges HoMF may restrict access to protect privacy and integrity.
2.2 Limited Access; No Membership. User is not a HoMF Member. User’s access is limited, revocable, and may be modified or terminated at any time consistent with this Agreement and Policies.
2.3 Eligibility; Minors. The Platform is intended for adults. User represents User is at least eighteen (18) years old. HoMF does not knowingly collect personal information from children. If HoMF learns that a minor has provided personal information or created an account in violation of this Section, HoMF may delete the account and information and terminate access.
2.4 Termination; Suspension. HoMF may suspend or terminate User’s access immediately for any breach, suspected misuse, security risk, or to protect privacy and platform integrity. HoMF may also discontinue any feature or Content at any time. User may stop using the Platform at any time by discontinuing access and, where offered, requesting account closure.
2.5 Changes. HoMF may amend this Agreement and Policies by posting updates on the Platform with an effective date. Continued use after the effective date constitutes assent. If User does not assent, User’s remedy is to discontinue use.
3. LIMITED LICENSE; PERMITTED USE; RESTRICTIONS; NON-RELIANCE
3.1 Limited License. Subject to compliance with this Agreement, HoMF grants User a limited, non-exclusive, non-transferable, revocable license to access the Platform and Educational Materials for personal educational use only.
3.2 No Legal Advice; Educational Purpose Only. HoMF provides general educational information and tools. Nothing on the Platform constitutes legal advice, representation, or a lawyer-client relationship. User is solely responsible for how User uses any information or outputs.
3.3 Non-Reliance; No Professional Relationship. User acknowledges User is not relying on HoMF or UDCM for legal, medical, financial, or professional advice. HoMF is not a law firm and does not provide attorney-client services. User assumes all risk from use of Content or any Document Generator Output and is responsible for obtaining independent professional advice as appropriate.
3.4 No Public Redistribution. User shall not publish, repost, distribute, sell, sublicense, or otherwise share Content, Educational Materials, Document Generator Output, template logic, or any portion thereof, except where HoMF expressly authorizes in writing.
3.5 No Automated Extraction. User shall not scrape, crawl, index, data-mine, bulk download, systematically capture, or use bots, scripts, or automated tools to extract Content or Educational Materials.
3.6 No Reverse Engineering. User shall not reverse engineer, decompile, disassemble, or attempt to derive the source code, template logic, or system design of the Platform or any tool.
3.7 No Misrepresentation. User shall not hold out HoMF or UDCM as providing public legal services, public counseling, or regulated professional services, and shall not represent User as an authorized steward, chapter, branch, or affiliate without written authorization.
3.8 No Credential Sharing. User shall not share login credentials or allow another person to access the Platform through User’s account.
3.9 Prohibited Conduct. User shall not: (a) harass, threaten, stalk, or abuse any person; (b) dox or publish personal information; (c) upload or transmit malware, spyware, or harmful code; (d) phish, spoof, or attempt unauthorized access; (e) interfere with Platform security, rate limits, or access controls; (f) attempt credential stuffing or account takeover; (g) use the Platform for unlawful, deceptive, or fraudulent purposes; (h) circumvent access restrictions; (i) solicit or market competing services using HoMF Materials; (j) impersonate Stewards or Members; or (k) violate Policies.
4. DOCUMENT GENERATION; USER INPUTS; RESPONSIBILITY
4.1 User Inputs. User is solely responsible for the accuracy, legality, and appropriateness of all inputs provided to the Platform, including names, addresses, facts, and selections.
4.2 Output Limitations. Document Generator Output is generated from standardized templates and User inputs. HoMF does not warrant that any output is suitable for any particular legal purpose, jurisdiction, filing, or outcome.
4.3 Sensitive Information. User should not input sensitive personal data unless the Platform expressly requests it for formatting. HoMF may process data as described in Policies.
4.4 Risk Allocation. User accepts that automated generation may include errors or omissions. User must review, verify, and adapt any output to User’s circumstances and applicable law.
5. CONTRIBUTIONS; GIFTS; NO QUID PRO QUO; PROCESSORS; REFUNDS
5.1 Voluntary Support. HoMF may request voluntary contributions to support the association’s mission and operating costs. Contributions are voluntary and not a purchase of legal services or a sale of goods.
5.2 No Quid Pro Quo. Access levels, if any, are governed by HoMF’s posted access rules and may be changed or revoked. User acknowledges that contributions are mission support and are not consideration for any promise of consultation, document preparation, particular content, or any particular outcome.
5.3 Payment Processing; Disputes. If User transmits voluntary contributions through a third-party processor, User agrees to comply with the processor’s terms. HoMF may suspend access during an active payment dispute or chargeback investigation. This does not limit User’s rights in the event of bona fide payment fraud or unauthorized transactions.
5.4 Refunds; Contribution Policy. Unless HoMF expressly states otherwise in a written policy for a specific program, voluntary contributions are not refundable. If HoMF offers paid access tiers in the future, refund, proration, and tax treatment (if any) will be governed by the posted policy for that tier and incorporated by reference.
6. PRIVACY; CONFIDENTIALITY; DATA SECURITY; PLATFORM INTEGRITY
6.1 Policies Incorporated; Consent. HoMF’s Privacy Policy, Cookie Policy (if any), Data Security Policy, and Records Retention Policy are incorporated by reference. By using the Platform, User consents to processing, storage, and transfer of information as described in Policies, including cross-border transfers if User accesses the Platform from outside the United States.
6.2 Confidential Information. User shall hold Confidential Information in strict confidence and shall not disclose it except as required by nonwaivable law and only to the minimum extent legally required.
6.3 No Recording; No Screenshots of Private Areas. User shall not record or capture (including screenshots/screen recordings) private areas of the Platform, private forums, internal communications, or any confidential content, except where HoMF expressly authorizes in writing.
6.4 Security; Incident Notice. User shall use reasonable safeguards to protect account access and shall promptly notify HoMF of suspected compromise, phishing, unauthorized access, or leakage of Content or Confidential Information.
6.5 Takedown/Deletion Cooperation. If HoMF reasonably believes User has disclosed or leaked Content or Confidential Information, User shall promptly cooperate with mitigation, including removal/takedown, deletion, and written certification of steps taken.
7. INTELLECTUAL PROPERTY; MARKS
7.1 Ownership. The Platform and Content are owned by HoMF and/or its licensors and are protected by intellectual property laws. No rights are granted except the limited license stated herein.
7.2 Marks; No False Affiliation. User shall not use HoMF or UDCM names, logos, seals, or marks in a way that implies endorsement or affiliation, or suggests an official chapter/branch, without prior written authorization.
7.3 Feedback. If User submits feedback or suggestions, User grants HoMF a non-exclusive right to use it without compensation or restriction.
7.4 Reservation of Rights. All rights not expressly granted are reserved by HoMF and/or its licensors.
8. PETITIONS; COMMUNITY ACTION TOOLS
8.1 Optional Tools. HoMF may offer petition signing or community action tools in the future. Such tools are informational and voluntary and may be subject to additional posted terms.
8.2 User Responsibility. User is solely responsible for the accuracy of User’s statements, signatures, and compliance with applicable laws governing petitions or public submissions.
8.3 No Agency Relationship. Participation in any petition tool does not make HoMF User’s agent or representative and does not create any duty to file, submit, or maintain any petition.
9. DISCLAIMERS; LIMITATION OF LIABILITY; AVAILABILITY
9.1 No Warranties. The Platform and Content are provided “as is” and “as available.” HoMF disclaims all warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement.
9.2 No Guarantee of Results. HoMF does not guarantee that any Educational Materials, Document Generator Output, or other content will achieve any particular result or be accepted by any agency, court, or third party.
9.3 Third-Party Services and Links. The Platform may integrate or link to third-party services (e.g., hosting, payment processors, email, analytics, embedded video) and third-party sites. HoMF does not control and is not responsible for third-party content, terms, or practices. User’s use of third-party services is at User’s own risk and subject to their terms.
9.4 Availability; Maintenance; Force Majeure. HoMF does not guarantee uninterrupted availability. The Platform may be unavailable due to maintenance, upgrades, network issues, third-party outages, or events beyond HoMF’s reasonable control (including acts of God, governmental action, labor disputes, or cyber incidents).
9.5 Limitation of Liability. To the maximum extent permitted by nonwaivable law, HoMF and UDCM shall not be liable for indirect, incidental, special, consequential, or punitive damages. To the maximum extent permitted, HoMF’s total liability for any claim arising out of or relating to the Platform shall not exceed the greater of (a) the amount User paid via third-party processors as voluntary contributions in the three (3) months before the event giving rise to the claim, or (b) $100.
9.6 Allocation of Risk. User acknowledges that these limitations are an essential basis of the bargain and that access may be denied without them.
9.7 Accessibility; User Responsibility. HoMF makes reasonable efforts to provide access but does not warrant that the Platform will meet User’s specific accessibility needs or device compatibility requirements.
10. INDEMNITY
10.1 User Indemnity. User shall indemnify and hold harmless HoMF, UDCM, and Stewards from claims, demands, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from User’s breach of this Agreement, misuse of the Platform, violation of law, or infringement claims based on User’s inputs or conduct, except to the extent caused by HoMF’s willful misconduct.
11. DISPUTE RESOLUTION
11.1 Notice and Opportunity to Cure. Before initiating arbitration, User shall provide HoMF written notice describing the dispute and relief sought and allow thirty (30) days for good-faith internal resolution, except where emergency protective measures are required for confidentiality or security.
11.2 Mandatory Arbitration; AZ-RUAA. Any dispute, claim, or controversy arising out of or relating to the Platform, Content, or this Agreement shall be resolved by binding arbitration administered under the Arbitration Rules and, where applicable, the Arizona Revised Uniform Arbitration Act, A.R.S. §§ 12-3001 to 12-3029 (“AZ-RUAA”).
11.3 Limited Court Role. Courts may be used only for (a) provisional relief in aid of arbitration where permitted by law, and (b) confirmation, vacatur, modification, or enforcement of an award. If federal preemption applies, the Federal Arbitration Act may govern solely to the minimum extent required.
11.4 Seat; Venue. The seat of arbitration shall be Maricopa County, Arizona. Any permitted court action shall be brought exclusively in the state courts located in Maricopa County, Arizona, or, if federal jurisdiction exists, in the United States District Court for the District of Arizona.
11.5 Individual Proceedings; Class Waiver. Arbitration shall proceed only on an individual basis. No class, collective, representative, or private attorney general proceedings are permitted, to the maximum extent allowed by nonwaivable law. If the class/collective waiver is held unenforceable, it shall be severed and any class/collective claim shall proceed only in a court of competent jurisdiction; all other claims remain subject to individual arbitration.
11.6 Confidential Proceedings. Arbitration filings, proceedings, and awards are Confidential Information. Any court filing shall be narrowly tailored and, where available, filed under seal or with confidentiality protections.
11.7 Waiver of Jury Trial. To the maximum extent permitted by law, the Parties waive any right to a jury trial in any permitted court proceeding.
11.8 Limitations Period. To the maximum extent permitted by nonwaivable law, any claim arising out of or relating to the Platform or this Agreement must be brought within one (1) year after accrual, or it is barred.
12. ELECTRONIC RECORDS AND SIGNATURES
12.1 Electronic Assent. A record or signature may not be denied legal effect solely because it is in electronic form. See A.R.S. §§ 44-7001 to 44-7061 (Arizona Electronic Transactions Act), to the extent applicable.
12.2 Authentication. HoMF may rely on platform logs, assent logs, IP address logs, and account authentication measures as evidence of assent and acceptance.
13. MISCELLANEOUS
13.1 Governing Law. Except to the extent federal law preempts state law on a particular issue, this Agreement and all Platform-related matters are governed by Arizona law, without regard to conflicts principles.
13.2 Nonwaivable Law Controls. Nothing herein waives rights or imposes duties that cannot be waived under nonwaivable law. Any provision shall be construed to preserve enforceability to the maximum extent permitted.
13.3 Severability; Reformation. If any provision is held invalid or unenforceable, it shall be reformed or limited to the minimum extent necessary to be enforceable and to best effectuate the Parties’ intent.
13.4 No Waiver. Failure to enforce any provision is not a waiver of future enforcement.
13.5 Assignment. User may not assign this Agreement. HoMF may assign this Agreement as part of a restructuring or transfer of administrative functions consistent with its governance, provided User protections are not materially reduced.
13.6 Relationship; No Employment. Nothing in this Agreement creates employment, agency, partnership, joint venture, or fiduciary obligations. User has no authority to bind HoMF or UDCM.
13.7 Notices. Notices to HoMF shall be delivered by the method stated on the Platform or in Policies. Notices to User may be provided by email or platform notice.
13.8 Entire Agreement. This Agreement and incorporated Policies are the entire agreement regarding User’s Platform access and supersede prior discussions.
13.9 Records Retention; Preservation. HoMF may retain logs, security records, access records, and communications for operational, security, or dispute-resolution purposes consistent with Policies. If HoMF provides a preservation notice, User shall preserve relevant evidence, including communications and files, and shall not delete or alter them pending resolution.
13.10 Survival. Sections concerning confidentiality/privacy, intellectual property, disclaimers and limitation of liability, indemnity, dispute resolution, limitations period, and any obligations that by their nature should survive shall survive termination or account closure.
13.11 Acknowledgment. User acknowledges a reasonable opportunity to review this Agreement, ask questions, and consult independent counsel, and agrees voluntarily.
14. DMCA / COPYRIGHT AND IP TAKEDOWN
14.1 Notice. If you believe Content infringes your copyright or other IP, send a written notice identifying the work claimed infringed, the material to be removed (with URL/location), your contact information, a statement of good-faith belief, and a statement under penalty of perjury that the information is accurate and you are authorized to act. Notices must be sent to the address or email designated on the Platform or in Policies.
14.2 Response; Repeat Infringers. HoMF may remove or disable access to allegedly infringing material and may terminate accounts of repeat infringers in appropriate circumstances.
14.3 Counter-Notice. If you believe material was removed by mistake or misidentification, you may submit a counter-notice with your contact information, identification of the removed material, a statement under penalty of perjury of good-faith belief, and consent to jurisdiction and service as required by nonwaivable law.
ELECTRONIC ASSENT
By using the Platform, User agrees to be bound by this Agreement as of the Effective Date.
