Can a trust open a bank account?
Yes it is common for trusts to open bank accounts. It is generally known that an Employer Identification Number (EIN) is first needed before a bank account can be opened. In most states, banks will at least need to see a Certification of Trust document drafted according to statute. This document cites the statute from the state in which the account is being opened to show the bank sworn or affirmed evidence that the trust exists as well as other for the purpose of trust privacy. Most states have a similar statute under their Trusts and Estates title of the code. Here is an example of Florida's Certification of Trust statute. Most banks will accept the Certification of Trust to open an account. Some banks may require a copy of the full trust. Some people choose not to supply a copy of their trust and move onto another bank of the bank will not accept their certification of trust. Some people also choose to open a personal trust checking account not a business checking account.
