How do I know if the government has contracted with me?
A contract has elements such as 1) offer and acceptance, 2) consideration, 3) a meeting of the minds, 4) mutual assent, 5) legal capacity to contract (age of majority and mentally fit) and of course 6) legality of contract. The elements need to be in place for a contract to arise either in written or verbal form (express) or by implication (implied which is referred to as operation of law) and is based on the actions of the parties even though there is no written contract. Consideration can be the exchange of money, a right or any other tangible or intangible thing of value. If there is no consideration, there is no contract. The consideration must be bargained for which is when either party negotiates the terms of the valuable exchange. Many people today feel governments enter in a commercial contract with their citizens which they claim is how they impose statutes upon them. This is not true because there would have to be a bargaining between citizens and their government which there is not. This claim is not proved with any legal fact and is merely a legal theory.
